Terms and Conditions

By confirming a booking, making a payment or proceeding with use of The Boiler Works’ services or facilities, the customer agrees to be bound by these Terms and Conditions.

1. Single Bookings and Cancellations

A minimum of 48 hours’ notice is required to cancel or rearrange a single room-hire booking.

Where less than 48 hours’ notice is provided, the full booking charge will remain payable.

Where sufficient notice is provided, any request to rearrange the booking will be subject to availability.

Failure to attend a booking without providing the required notice will be treated as a late cancellation and the full booking charge will remain payable.

2. Recurring, Block and Monthly Bookings

2.1 Recurring bookings

Where a customer has agreed a regular recurring booking, including a weekly or multiple-times-per-week booking, the agreed days and times are reserved exclusively for that customer on an ongoing basis.

The agreed monthly or block charge is payable in consideration for The Boiler Works reserving and maintaining availability of those recurring time slots, regardless of whether the customer chooses to use every reserved session.

2.2 Cancellation or non-attendance of individual sessions

Cancellation, non-attendance or non-use of an individual session within a recurring, block or monthly booking does not reduce the agreed charge and does not create an entitlement to a refund, credit or reduction against a future invoice.

Unused sessions cannot be carried forward or accumulated for use at a later date unless expressly agreed by The Boiler Works.

2.3 Requests to move individual sessions

Requests to move or rearrange an individual recurring session may be considered at the discretion of The Boiler Works and are subject to room availability.

The Boiler Works is under no obligation to provide an alternative date or time where a customer is unable to attend their usual reserved session.

Where an alternative session is agreed, this does not alter the customer's normal recurring booking or agreed monthly charge unless expressly agreed in writing.

2.4 Permanent changes to recurring bookings

A minimum of 30 days’ written notice is required where a customer wishes to permanently reduce, remove or change any of their regular recurring days or times.

Until that notice period has expired, the existing booking arrangement and associated charges will continue to apply.

Any proposed replacement day or time is subject to availability and must be agreed by The Boiler Works.

2.5 Ending a recurring booking

Recurring bookings continue on an ongoing basis until terminated by either party.

Customers must provide a minimum of 30 days’ written notice to terminate a recurring, block or monthly booking.

Charges remain payable for the reserved booking throughout the notice period, whether or not the customer chooses to use the room during that period.

The Boiler Works may also terminate or amend a recurring booking by providing reasonable notice.

2.6 Temporary absence

Holidays, work commitments, illness or other temporary circumstances do not automatically suspend a recurring booking or its associated charges.

Where a customer wishes to temporarily release their recurring booking, this must be agreed with The Boiler Works in advance.

Where a booking is released, The Boiler Works cannot guarantee that the same days or times will remain available when the customer wishes to resume.

2.7 Monthly invoices

Invoices for recurring bookings relate to the reservation and availability of the customer's agreed recurring time slots for the relevant billing period and are not calculated solely according to the number of sessions actually attended.

Payment remains due in accordance with the payment terms stated on the invoice.

3. Payment and Late Payment

Payment must be made by the due date stated on the relevant invoice.

Where payment is overdue, The Boiler Works reserves the right to suspend future bookings or services until the account has been brought up to date.

Where a booking is made by a business or for business purposes, The Boiler Works also reserves any statutory rights available in relation to late commercial payments, including the right to claim applicable statutory interest and debt recovery costs.

Continued or repeated late payment may result in The Boiler Works withdrawing credit or recurring-booking arrangements and requiring future bookings to be paid for in advance.

4. Deposits

Where a deposit is required to secure a booking, the amount and purpose of the deposit will be made clear at the time of booking.

Where a customer cancels a booking, The Boiler Works may retain all or part of a deposit where reasonably necessary to cover losses arising directly from the cancellation, including where the reserved date or time cannot reasonably be rebooked.

Any amount retained will be reasonable having regard to the circumstances of the cancellation and the losses incurred by The Boiler Works.

Nothing in these Terms affects any statutory rights the customer may have.

5. Advance Payments

Where payment is made in advance for a booking that is subsequently cancelled by the customer, the cancellation provisions contained within these Terms will apply.

The Boiler Works may retain amounts reasonably attributable to the cancellation, including charges properly due under the applicable cancellation notice period.

Where The Boiler Works is unable to provide a service for which advance payment has been made, the customer will normally be offered an alternative date or an appropriate refund for the service that The Boiler Works is unable to provide.

Nothing in these Terms limits any statutory right to a refund where one exists.

6. Booking Confirmation

Submitting a booking request does not automatically guarantee that a room, studio, date or time is available.

A booking is only confirmed once The Boiler Works has confirmed acceptance of the booking.

Customers should not assume that a provisional or requested booking has been secured until confirmation has been received.

7. Studio and Room Hire Agreements

Customers hiring the photography studio or any other space for which The Boiler Works requires a separate hire agreement must complete and agree to the applicable hire agreement before using the facilities.

Customers must comply with any reasonable health and safety, fire safety, equipment-use or building instructions provided by The Boiler Works.

The person making the booking is responsible for ensuring that anybody attending as part of their booking complies with these requirements.

8. Cancellations by The Boiler Works and Events Beyond Our Control

The Boiler Works will make reasonable efforts to provide all confirmed bookings as agreed.

We will not be responsible for a failure or delay in providing a booking where this results from circumstances beyond our reasonable control, including but not limited to fire, flood, serious damage to the premises, utility failure, government restrictions, emergency closure or other events which prevent the facilities from being safely or reasonably used.

Where The Boiler Works is unable to provide a booked session, we will where reasonably possible offer an alternative date or time.

Where an appropriate alternative cannot be provided, any amount paid specifically for the booking that The Boiler Works is unable to fulfil will be refunded where required.

9. Third-Party Services

Where a third-party company, supplier, contractor or service provider is introduced to or used by a customer in connection with a booking, that third party remains responsible for the services it provides.

The Boiler Works is not responsible for the acts, omissions or performance of an independent third-party provider where that provider's services are outside the reasonable control of The Boiler Works.

Nothing in this clause excludes or limits liability where it would be unlawful to do so.

10. Website, Photography and Intellectual Property

Unless otherwise stated, the text, graphics, branding and other original content created by and belonging to The Boiler Works and displayed on its website or official social-media channels remain the intellectual property of The Boiler Works or its respective rights holder.

Such content may not be reproduced, distributed or used commercially without the permission of the applicable copyright owner.

Images, music, artwork or other material belonging to third parties remain the property of their respective copyright owners.

11. Prices

Prices published by The Boiler Works are correct at the time of publication but may be amended from time to time.

Any price change will not normally affect an individual one-off booking that has already been confirmed at an agreed price.

The Boiler Works reserves the right to review prices applicable to ongoing, recurring or monthly arrangements by providing reasonable notice before the new price takes effect.

12. Customer Responsibility and Damage

Customers are responsible for treating The Boiler Works premises, equipment, fixtures and furnishings with reasonable care.

Customers must notify The Boiler Works promptly of any damage or fault occurring during their booking.

Where damage is caused deliberately or through negligence or misuse by the customer or someone attending as part of their booking, The Boiler Works reserves the right to recover the reasonable cost of repair or replacement from the customer responsible for the booking.

13. Conduct and Safety

The Boiler Works reserves the right to refuse or terminate use of the premises where a customer's behaviour creates a genuine safety risk, causes significant disruption, involves unlawful activity or constitutes serious or repeated breach of these Terms or applicable studio rules.

Customers must follow reasonable instructions given by The Boiler Works concerning the safe use of the premises and equipment.

Where a booking is terminated because of serious misconduct or a material breach by the customer, this will not automatically entitle the customer to a refund.

14. Personal Property

Customers remain responsible for their own equipment and personal belongings while using The Boiler Works.

The Boiler Works will not be responsible for loss, theft or damage to personal property except where such loss or damage results from negligence or another liability that cannot lawfully be excluded.

Customers should ensure that valuable equipment is appropriately insured where necessary.

15. Changes to These Terms

The Boiler Works reserves the right to amend or update these Terms and Conditions from time to time.

The current version of these Terms and Conditions will be published on The Boiler Works website and customers are responsible for referring to the current terms when making or continuing bookings.

Terms and Conditions apply to all bookings and ongoing hire arrangements where stated on booking confirmations, invoices or other correspondence.

Changes to these Terms will apply to bookings and services from the date the updated Terms are published, subject always to any applicable statutory rights and any terms already contractually agreed in relation to a particular booking.

16. Statutory Rights

Nothing in these Terms and Conditions excludes or limits any rights or remedies that cannot legally be excluded or limited.

Where the customer is acting as a consumer, these Terms are intended to operate alongside the customer's applicable rights under UK consumer law.
